Should I choose mediation or litigation in my Las Vegas divorce?

If you are facing a divorce in Las Vegas, especially if you have a high net worth, you may have several unanswered questions about how to start the process. One of the very first decisions many people face is that of whether to attempt a mediation in the divorce process or to go straight to the courtroom for formal litigation.

There are several factors that can help you determine whether mediation is an option in your particular situation. You should also consider circumstances in which mediation may actually hamper your chances for moving forward successfully. Here is some information to help you determine which route may be the better one for you.

Benefits of mediation

Meditation in a divorce has several benefits. Mediation assumes as a baseline premise that you and your spouse are willing to come together to establish a shared agreement about how to proceed in your divorce. Often these center mainly on asset division and finances on the one hand, and if you and your spouse have children, custody and visitation rights on the other.

Mediation can help reduce conflict and psychological stress for families with children. Court battles over child custody and visitation can quickly turn very bitter and drawn out. If you and your spouse are willing to come to shared agreements about your children, mediation can be your first option and help you maintain control over the decision-making process

When mediation is not an option

Some couples are not good candidates for mediation because they have reached a level of hostility and disagreement that makes it impossible to sit down with a mediator and try to work out a shared agreement. If you own a business and your spouse wants control over the assets, or if your spouse has ideas about child custody and visitation that do not reconcile with your own wishes, you may need to turn to the courts and a judge for the best outcome.

Many couples in Las Vegas have one or both spouses who work in the casino industry. These couples face special circumstances when it comes to child custody and visitation because they often have unusual schedules and work odd or late hours. This circumstance can make it difficult to find a shared agreement with your spouse.

Whether feel you could benefit from mediation or you are already sure that your case is beyond the ability to seek a shared agreement outside the courtroom, the bottom line is that you should seek a qualified family law attorney in Las Vegas. A lawyer will help you plan your way forward to ensure that you have the best possibility for a successful post-divorce future on both a financial and personal level.
